Official Regulations

NO PURCHASE IS REQUIRED TO PARTICIPATE OR WIN. BUYING WILL NOT ENHANCE YOUR CHANCES OF SUCCESS. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS ARE APPLICABLE. INVALID WHERE PROHIBITED.

This giveaway is not supported, sponsored, or affiliated in any way with any firearm dealers, manufacturers, or brands, nor are these companies or their trademarks associated in any manner with Gun Gear Deal or this giveaway.

ELIGIBILITY

The giveaway is open to legal residents of the fifty (50) states of the United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and are legally permitted to own a firearm. Employees of Gun Gear Deal and other companies involved in promoting the giveaway, as well as their immediate family members (spouse, parents, siblings, and children), and household members, are not eligible to participate. The giveaway is subject to applicable federal, state, and local laws and regulations. Participation signifies the entrant's complete and unconditional agreement to abide by these official regulations and the decisions made by the sponsor, which are final and binding in all matters pertaining to the giveaway. The sponsor reserves the right to verify the eligibility of the winner. Any entry that violates these giveaway regulations or is prohibited or restricted by law will be deemed invalid.

ACCEPTANCE OF OFFICIAL REGULATIONS

Participating in the giveaway indicates the entrant's complete and unconditional acceptance and agreement to these official regulations and the sponsor's decisions, which are final and binding. Winning a prize is contingent upon compliance with these official regulations and fulfilling all other requirements stated herein.

GIVEAWAY PERIOD

The giveaway begins on July 5th, 2023, at 12:01am Eastern Daylight Time (EDT) and concludes on December 31st, 2023, at 11:59pm Eastern Daylight Time (EDT) (the "Giveaway Period"). Entries submitted before or after the Giveaway Period will be disqualified. Submissions will be accepted throughout the Giveaway Period using any of the following methods: Online.

HOW TO PARTICIPATE

To have a chance to win the prize, participants ("Entrants") can enter the giveaway during the Giveaway Period by accurately and completely filling out an online entry form on Gun Gear Deal's website ("Website"). Participation is LIMITED TO ONE (1) ENTRY PER PERSON PER GIVEAWAY PERIOD. If more than one (1) entry is received from any individual during the giveaway period, only the first processed entry will be considered valid. In the event of a dispute regarding an entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of entry. The authorized account holder is the natural person assigned to the email address by an internet service provider or other organization responsible for email address assignment or the domain associated with the submitted email address.

Only one (1) entry per person, email address, and household is allowed during the Giveaway Period, regardless of the method of entry. Entries received from any person, email address, or household exceeding this limitation will be void. All entries become the property of the sponsor and will not be acknowledged or returned. 

WINNER NOTIFICATION

On or around December 31st, 2023, the sponsor will randomly select potential winners from all eligible entries received. The odds of being selected depend on the total number of entries received. The sponsor will attempt to notify the potential winner via email on or around January 7th, 2023. If the potential winner cannot be contacted within five (5) days after the initial contact attempt, the sponsor.  

- PRIZES

One participant will receive a $2,000 check to purchase the Dan Wesson DWX pistol.

The Sponsor reserves the right to offer only the designated number of prizes through a random drawing from all valid and unclaimed eligible prize claims. Each entrant and household is limited to one prize only. Prizes cannot be combined with any other promotions or offers. Prizes cannot be substituted, assigned, transferred, or redeemed for cash by the winner.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SPONSOR SHALL NOT BE LIABLE FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, LEGAL ISSUES, OR OTHER DAMAGES OR EXPENSES ARISING FROM OR RELATED TO THE PRIZE OR ANY OTHER ASPECT OF THE WINNER'S ACCEPTANCE OR USE OF THE PRIZE.

All details regarding the prize are at the sole discretion of the Sponsor. The Sponsor is required by law to report the prize where necessary. If appropriate, the winner will receive an IRS form 1099 or W-8BEN.

GENERAL CONDITIONS

If the Giveaway's operation, security, or administration is impaired in any way due to fraud, virus, bug, unauthorized human intervention, or any other technical problem, or if the Giveaway cannot proceed as planned for any other reason determined by the Sponsor, the Sponsor may, at its sole discretion, either suspend the Giveaway and resume it in a manner that aligns with the Official Rules or terminate the Giveaway. In the event of termination, the Sponsor may randomly select a winner from eligible non-suspect entries received up to the time of the impairment. The Sponsor reserves the right to disqualify any individual found tampering with the entry process or the operation of the Giveaway or acting in violation of the Official Rules. Any attempt to damage the website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law. In such cases, the Sponsor reserves the right to seek damages and remedies to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of the Official Rules shall not constitute a waiver of that provision. Entrants may withdraw their consent at any time by sending a written email request to info@gungeardeal.com with the subject line "OPT-OUT."

RELEASE AND LIMITATIONS OF LIABILITY

By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, its parent company, subsidiaries, affiliates, advertising and promotion agencies, and other companies associated with the Giveaway, as well as their respective officers, directors, employees, shareholders, representatives, and agents (the "Released Parties"), from any claim or cause of action arising from participation in the Giveaway or the receipt or use of the prize. This includes any technical errors, unauthorized human intervention, mechanical, network, electronic, computer, printing, or typographical errors. Entrants waive the right to claim any damages other than actual out-of-pocket expenses. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or any equipment or programming associated with the Giveaway. Entrants waive the right to claim any damages whatsoever, including punitive, consequential, direct, or indirect damages.

 DISPUTES

To the fullest extent permitted by law, any disputes, claims, or causes of action arising from or connected with the Giveaway or any awarded prize shall be resolved on an individual basis, without resorting to any class action, and exclusively in the State and/or Federal Courts located in Florida. (2) All claims, judgments, and awards will be limited to actual costs incurred, including expenses associated with participating in the Giveaway, but excluding attorneys' fees. (3) The Entrant waives the right to seek or obtain any awards for indirect, punitive, incidental, consequential damages, or any other damages (except for actual out-of-pocket expenses), and waives any rights to have damages multiplied or increased in any way.

All matters and inquiries regarding the creation, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Giveaway, shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of laws principles of any other jurisdiction that would result in the application of the laws of any jurisdiction other than the State of Florida.

ACCEPTANCE CRITERIA: In order to be considered an official winner, the potential winner must agree to each of the following Acceptance Criteria:

* a. Submit a current photograph of themselves via email in JPEG format.

* b. Sign an Affidavit of Eligibility, Liability & Publicity Release (where permitted by law) within ten (10) days of notification (as detailed in the section titled "Release and Limitations of Liability").

* c. Provide feedback upon request by the Sponsor regarding their satisfaction with the prize. 

PUBLICITY GRANT: Unless prohibited by law, the Winner grants the Sponsor (with written confirmation upon Sponsor's request), its parent company, any subsidiaries, affiliates, retailers, distributors, advertising and promotion agencies, suppliers, and those acting under its authority, the right and permission to print, publish, broadcast, and use worldwide, in any media now known or developed in the future, including but not limited to the internet, the Winner's name, portrait, picture, city/town of residence, voice, likeness, opinions, and biographical information for advertising, trade, and promotional purposes (including the announcement of the Winner's name on television or radio broadcasts), without any additional consideration, compensation, permission, or notification. 

EMAIL COLLECTION: Any email addresses collected during this Giveaway will be used for the purpose of offering additional services and products. By entering this sweepstakes, you agree that you are subscribing to the Sponsor's email newsletter(s) as indicated on the Sweepstakes Page for that specific sweepstakes, or granting your consent for the Sponsor to add you to their newsletter subscription list. Participants must remain subscribed to all specified newsletters throughout the Sweepstakes Period in order to be eligible to win a prize. If a Participant unsubscribes during the Sweepstakes Period, they will be disqualified from winning.
